1. THIS IS AN AGREEMENT BETWEEN YOU AND BESTQUOTE TRAVEL INSURANCE AGENCY

By using the Bestquotetravelinsurance.ca website, a service provided by BestQuote Travel Insurance Agency (herein referred to as “the Service”) for the purposes of informing the general public about travel insurance and advising on options for obtaining coverage, you agree without qualification or limitation to enter into a service contract whereby in consideration for receiving such information you agree to be bound by the following terms and conditions (“Terms of Use” ):

Bestquotetravelinsurance.ca reserves the right to update and change the Terms of Use from time to time without notice. Any new features or changes of the Service, including the release of new tools and features, shall be subject to these Terms of Use. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Use at any time on the website.

2. Copyright 

All content included on Bestquotetravelinsurance.ca, including but not limited to all text, graphics, logos, icons, images, audio clips, information, documents, products and services, and software (collectively, the “Goods”) - is the property of bestquotetravelinsurance.ca and/or its affiliates and/or content suppliers, and is protected by Canadian and International Copyright laws. Except as stated herein, none of the Goods may be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to electronic, mechanical, photocopying, recording or other means, without the prior express written permission of Bestquotetravelinsurance.ca.

3. Limited License

Bestquotetravelinsurance.ca grants you a limited license that authorizes you to view, copy, download and print materials made available on this website, provided that: (1) if you are not licensed to sell travel insurance, the materials are used solely for personal, non-commercial purposes, and you do not use them to advise others about obtaining insurance; (2) if you are licensed to sell travel insurance and your use of the Service is to help your clientele and use this Service to aid such commercial purposes, you agree to compensate Select First Financial Services Inc. by paying $10 per quote obtained and/or 50% of all commissions received from sales of any insurance products displayed on your quote, in addition to interest charges as set by a regulatory authority or court with jurisdiction; (3) the materials are not modified or redistributed; and (4) all copyright, trademark, service mark and other proprietary notices are reproduced as they appear in any such materials. Any unauthorized use terminates the permission or license granted by Bestquotetravelinsurance.ca.

4. Disclosure of Commissions

Bestquotetravelinsurance.ca is a service provided by Select First Financial Services Inc., a licensed insurance agent in the provinces of British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, New Brunswick, Nova Scotia, Prince Edward Island, Newfoundland and Labrador, as well as the Northwest Territories.

The information on this website is not intended to be an offer to sell or advise on any product or service by us in any jurisdiction where such an offer would be unlawful or where we are not licensed to do so. The insurance premiums that we quote are provided directly by the insurance companies, which are regulated by various provincial insurance authorities. Regulations prevent insurance companies and their representatives from rebating or marking up premiums to customers, so the rates we quote are the same as those offered by the insurance companies themselves or other insurance agents and brokers representing them. You will not find a lower premium for the same insurance plans.

BestQuote Travel Insurance Agency is a licensed accident and sickness insurance agent, and will receive commissions from the insurance company or its managing general (insurance) agent (MGA) when a new policy is issued through the use of this website. 

5. Trademarks

Bestquotetravelinsurance.ca, other trademarks, trade names and service marks (the “Marks”) displayed on this website are the property of BestQuote Travel Insurance Agency and/or its parent company Select First Financial Services Inc. Bestquotetravelinsurance.ca graphics, logos, page headers, button icons, scripts, code and service names are trademarks or trade dress of Bestquoutetravelinsurance.ca and/or its affiliates. Users are not permitted to copy or otherwise use these Marks without the prior written consent of Bestquotetravelinsurance.ca or such affiliate which may own the Mark.

6. Devices

You agree that you will not use any robot, spider, script, other automatic device, or manual process to monitor or copy our website pages or the content contained herein without our prior expressed written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Bestquotetravelinsurance.ca website. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our technological infrastructure.

You also agree not to re-engineer anything on this website in terms of all examinations and alterations of this system to reconstitute it in a new form. It is more accurate to say that you agree not to reverse engineer any part or in whole of this website, including the initial examination of the system, with the intent of re-engineering it subsequently to produce a modification and/or modified system to reconstitute it in a new form.

7. Applicable Laws

By visiting Bestquotetravelinsurance.ca, you will comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and any related activities. In the case of any dispute, the laws of the Province of British Columbia will govern these terms of use and any dispute of any sort that may arise between you and Bestquotetravelinsurance.ca. Any dispute relating in any way to your visit to the Service shall be submitted to confidential arbitration in Vancouver, British Columbia; except that, to the extent that you have in any manner violated or threatened to violate the intellectual property rights of Bestquotetravelinsurance.ca and/or its affiliates may seek injunctive or other appropriate relief in any provincial or federal court, and you consent to exclusive jurisdiction and venue in such courts.

8. Payments

Payment information is collected and retransmitted to the insurance company issuing the insurance policy, which then processes any payment. 

9. Refunds

Each insurance company will clearly state its refund policy which covers events like not leaving on your trip, coming back early etc. It is your responsibility to read your policy carefully before making a purchase and to understand the coverage benefits, possible exclusions and procedures for making claims or requesting refunds. All refund applications will be made directly to the insurance company issuing the policy in the manner described in your policy. If you have any problems having a refund issued by your insurance company, you may contact us to intervene and speak to the insurance company on your behalf. 

10. Claims

You agree to direct any claims requests directly to the insurance company that has issued your policy in the manner described by the insurance company in the policy.

11. Termination

Bestquotetravelinsurance.ca reserves the right to revoke your access and terminate your use of the website if it is in any way fraudulent, offensive, or violates any applicable laws. In our sole discretion, we may refuse to publish any content you provide at any time, for any reason, with or without notice.

12. Disclaimer of warranties and limitation of liability

The Bestquotetravelinsurance.ca website is provided on an “as is” and “as available” basis. To the best of our knowledge, the information placed on the Service is accurate at the time it is placed there, but the insurance companies can change their pricing or terms of coverage without our knowledge, and Bestquotetravelinsurance.ca makes no representations or warranties of any kind, expressed or implied, as to the operation of this site or the information, content, materials, or services included on this site. If any discrepancy arises between the premiums quoted by this site and the premium quoted by an insurance company based on the same information, the quote from the insurance company will be deemed to be accurate. Bestquotetravelinsurance.ca does not make offers to sell insurance at a differentiated premium.

You expressly agree that your use of this site is at your own risk. You expressly understand and agree that Bestquotetravelinsurance.ca and/or its parent company Select First Financial Services Inc., or any of its associates, advertisers, service providers, shareholders, employees, directors, or officers shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of income, loss of premium, loss of use, loss of data or other intangible losses resulting from: (i) the use or the inability to use the Service; (ii) an inaccurate quote; (iii) cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iv) unauthorized access to or alteration of your transmissions or data; (v) statements or conduct of any third party on the Service; (vi) termination of your account; or (vii) any other matter relating to the Service. 

13. Privacy Policy

The Bestquotetravelinsurance.ca Privacy Policy is displayed on our website and forms a part of these Terms of Use. All customers’ information is regarded as confidential and is safeguarded. Our Privacy Policy governs how we collect, use, retain and disclose personal information and complies with the requirements under the Personal Information Protection and Electronic Documents Act (PIPEDA). If you do not feel comfortable with our use of your personal information, please don’t use the website.

14. Communication

You authorize BestQuote Travel Insurance Agency to send communication via email and/or regular mail concerning travel and/or health insurance; or the use of this website. You agree to use your own email when requesting information from the website and that by doing so, we will communicate with you regarding your requested information. You may opt-out of future correspondence if you wish by selecting that option in the ‘edit profile’ tab in your member area, by clicking on the ‘unsubscribe’ button provided, or by replying to the email with ‘unsubscribe’ written in the subject line - which may take up to 72 hours to complete. By entering your email and requesting information, you agree that these opt-out provisions are acceptable. If you do not feel comfortable with receiving communications from us regarding your requested information, please don’t use the Service.

15. Security Statement

The Bestquotetravelinsurance.ca Security Statement is displayed on our website and forms a part of these Terms of Use. We maintain physical, electronic and procedural safeguards to protect the customer information we collect. Unauthorized access or use of personal information is prevented through the technological use of passwords, encryptions, firewalls and anti-virus software. Any personal information provided to our website is encrypted using Secure Socket Layer (SSL) technology. If you do not feel comfortable with the security procedures we have in place to safeguard the data on our website, please don’t use the Service. 

16. Links between Websites

Bestquotetravelinsurance.ca is not responsible for the content of, action or inaction of, nor does it endorse, the third-party websites to which you may link using this website; having a link from this website to another site does not imply approval of or endorsement of any other website by us. Any website linking to us may or may not be doing so with our permission, so you should not assume that the linking website has any authority to represent BestQuote Travel Insurance Agency or discuss insurance matters, make recommendations, or offer insurance advice. BestQuote Travel Insurance Agency cannot be held responsible for such third-party actions.

17. Modification of the Website

Bestquotetravelinsurance.ca may, at its sole discretion, improve, modify or remove any information or content appearing on the website at any time for any reason. Bestquotetravelinsurance.ca may discontinue or revise any or all aspects of the website at its sole discretion and without prior notice.

18. Modification of These Terms of Use 

Bestquotetravelinsurance.ca reserves the right to change the terms, conditions, and notices under which this Web site is offered at any time. Modification of this contract will be deemed effective upon publication on the Web site with respect to any visitor’s actions, communications or transactions occurring after said date. It is your responsibility to check the terms and conditions of this Agreement at the time of each use.

Our Agency will respond to the issues you raise in a professional, forthright and timely manner within two business days.

If you have a complaint about one of the insurance companies that we use with our customers, and/or about a claim-related issue, we encourage you to contact us first to help you learn the proper process to send them information about your complaint. Our advice may be quite helpful. 

If you remain dissatisfied, you may be entitled to refer your complaint to The OmbudService for Life & Health Insurance (OLHI), which provides free and impartial assistance with consumer complaints and inquiries about Canadian life and health insurance products and services. The OLHI can be contacted by telephone at 1-888-295-8112 and further information is available at https://olhi.ca/about-olhi/. If you do decide to refer any matter to the OLHI, your legal rights will not be affected.
